LOCAL OFF-DUTY POLICE
Off-duty police officers are often called upon to provide or enhance the security needs of manufacturing plants, retail establishments, office buildings, banks, hospitals, and other facilities. This generally entails contacting one or more local police agencies to arrange the coverage. This can become complicated with multiple officers, multiple sites, shift issues, and availability issues. It can also become an administrative nightmare to pay each officer every one or two weeks and to prepare appropriate tax forms for each officer at the end of every year.
Generally, if an off-duty officer at one of these facilities is injured while engaged in a law enforcement function, that officer’s police employer would, most likely, be responsible for any claims. However, if the officer should be injured at one of these facilities in a non-law enforcement capacity, then the business entity could likely be sued.
